A RESOLUTION DECLARING IT NECESSARY TO ACQUIRE PRIVATE PROPERTY IN THE CITY OF ANDALE, SEDGWICK COUNTY, KANSAS TO CONSTRUCT A SIGN TO DISPLAY NOTICES TO THE COMMUNITY AND FOR THE CITY AND AUTHORIZING A SURVEY AND DESCRIPTION OF THE LAND AND INTEREST TO BE MADE AND FILED WITH THE CITY CLERK

WHEREAS, City of Andale, Kansas ("City"), has determined that the orderly development and needs of the residents of the City requires the construction, maintenance and security of a sign to display notices to the community; and, WHEREAS, to construct, install, maintain and secure said new city sign to display notices to the community, it will be necessary for the City to acquire certain real estate and interests in said real estate from the owner of certain property;

NOW THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF ANDALE, KANSAS:

SECTION ONE: It is necessary to acquire additional real estate, and interest in real estate, from the owner of certain private property to construct, maintain and secure a new city sign. The City is hereby authorized to proceed with certain necessary condemnation proceedings authorized by KS.A. 26-201 et seq. and KS.A. 26-501 et seq. to secure the necessary real estate and interests. The Mayor of the City of Andale is authorized to cause a survey and description of the land and interests to be condemned to be made by a licensed land surveyor or a professional engineer who is competent to conduct a land survey, and such survey and description of land and interests shall be filed by the licensed land surveyor or professional engineer with the City Clerk.

SECTION TWO: After the filing of said survey and report, the City Attorney shall cause a proper ordinance to be prepared and submitted to the Governing Body for consideration, providing for the acquisition of private property in the City by appropriate proceedings in Eminent Domain.
