A CHARTER ORDINANCE REPEALING AND PROVIDING SUBSTITUTE TERMS FOR CHARTER ORDINANCE NO. 104 RELATING TO APPOINTED OFFICERS OF THE CITY.

NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ANDALE, KANSAS, PURSUANT TO THE POWER VESTED IN IT BY ARTICLE 12, SECTION 5, OF THE CONSTITUTION OF THE STATE OF KANSAS, HEREBY REPEALS AND PROVIDES SUBSTITUTE TERMS FOR SECTION 2 OF CHARTER ORDINANCE 104 WHICH EXEMPTS FROM AND MAKE INAPPLICABLE TO THIS CITY AN ACT OF THE KANSAS LEGISLATURE THAT IS NON-UNIFORM IN APPLICATION:

Section 1. The City of Andale, Kansas, pursuant to the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby repeals Section 2 of Charter Ordinance 104 which elected to exempt itself from and make inapplicable to this City an Act of the Kansas Legislature that is non-uniform in application, to wit, that portion of K.S.A. 15-204 and K.S.A. 15-209 relating to appointed officers of a city of the third class.

Section 2. The following is hereby substituted for Section 2 of Charter Ordinance 104 which exempts the City from K.S.A. 15-204 and the residency requirements contained in K.S.A. 15-209 and provides substitute terms therefore:

       The mayor of the City of Andale, Kansas, with the consent of the council, may appoint the following city officers:

(a)   a municipal judge of the municipal court;

(b)   a city attorney;

(c)   a city clerk;

(d)   a treasurer;

(e)   a marshal-chief of the police;

(f)   other law enforcement officers subordinate to the chief of police;

(g)   such other officers as deemed necessary.

       Such officers need not be qualified electors of the City of Andale, Kansas. This includes the appointment of nonresidents who also serve as city attorney, municipal judge, or law enforcement officers of other municipalities or public agencies. However, nothing herein shall authorize the appointment of nonresidents of the state of Kansas. The city attorney shall be a qualified elector of the county in which the City is located or of an adjoining county. Such officers shall hold their offices until their successors are appointed and qualified. The duties and pay of the various officers shall be set by resolution of the council. Any officer may be removed by a majority vote of the total membership elected or appointed to the council and may be suspended at any time by the mayor.
