CHAPTER 3. BEVERAGESCHAPTER 3. BEVERAGES\Article 7. Special Event Retailers’ Permits

The governing body of the City of Andale, Kansas, may issue special event retailers’ permits which will allow the permit holder to offer for sale, sell and serve cereal malt beverages for consumption on unpermitted premises, which may be open to the public, subject to the following:

(a)   A special event retailers’ permit shall specify the premises for which the permit is issued;

(b)   a special event retailers’ permit shall be issued for the duration of the special event, the dates and hours of which shall be specified in the permit;

(c)   no more than four special event retailers’ permits may be issued to any one applicant in a calendar year; and

(d)   a special event retailers’ permit shall not be transferrable or assignable.

The issuance and operation of a special event retailers’ permit shall be consistent with the requirements of K.S.A. 41-2701 et. seq., and amendments thereto. No person shall be issued a special event retailer’s permit unless such person meets the requirements for a cereal malt beverage license set forth in this chapter.

An application for a special event retailers’ permit shall be made on a form provided by the City Clerk and shall be accompanied by a permit fee in the amount of $25.00 for each day for which the permit is issued. This fee may be waived wholly or in part at the sole discretion of the governing body.

Any person selling cereal malt beverages without a special event retailers’ permit or without otherwise being legally licensed and/or permitted to sell such cereal malt beverages shall be subject to a fine of up to $2,000.00. This penalty is in addition to any other penalty provided by any other city ordinance or state law.
